Insurance Recovery
The firm has an active insurance recovery practice and is widely considered to be a leading policyholder-side firm in the Northwest. Lawyers in the firm have recovered substantial insurance proceeds from hundreds of domestic and foreign insurers. Our mission is to help clients maximize their insurance recovery in a cost-effective manner. We pursue negotiation opportunities when prudent. We consider alternative dispute resolution techniques when they hold promise. And, of course, we go to court when necessary.
Lawyers in the firm have successfully resolved claims and lawsuits in a wide range of insurance recovery areas, including asbestos, aviation, business interruption, business torts, contractor-controlled insurance programs (CCIPs), construction defects, directors & officers, errors & omissions, employment, environmental property damage and bodily injury, fire, flood, hearing loss, health care, intellectual property, long-term disability, owner-controlled insurance programs (OCIPs), professional liability, products liability, and workers' compensation. We also have significant expertise in broker/agent liability, state insurance department matters, insurer bad faith, lost policies, treaty reinsurance, facultative reinsurance, and London-market issues.
The firm’s insurance recovery practice runs the gamut from large-scale litigation on behalf of corporate policyholders under complex occurrence-based and claims made coverages to individual claims under property, disability, health, and other personal policies. We have represented policyholders in several high-stakes coverage matters, and we have also served as counsel to amici curiae in coverage litigation that has helped promote judicial developments favorable to policyholders. We are also regularly retained to represent brokers and agents and reinsurance intermediaries -- including some of the largest firms in the world -- when they become enmeshed in coverage disputes or coverage litigation.
Increasingly, we are providing proactive strategic coverage advice to clients. This includes evaluating the protections afforded to our clients under their current and contemplated insurance programs. We also work with clients to establish procedures for when and how to notify insurers of potential claims, and we often represent policyholders in dealing with adjusters throughout the process of resolving claims.
