Sierra Pacific/Firestone Litigation – Breach of Contract, Specific Performance

Ball Janik LLP defended Sierra Pacific in a lawsuit brought by a property owner for specific performance of a contract to purchase property for approximately $3 million, or alternatively for damages in excess of $1 million, as a result of the alleged breach of contract to purchase certain real property. Sierra Pacific asserted that certain material terms had not been met and that it was excused from performance. The case involved complex issues relating to land use rules, developability of the property, and county regulations.

After arbitration before a three arbitrator panel, the panel ruled that Sierra Pacific did not breach the agreement and that it was excused from performance. The binding final decision of arbitration panel resolved the matter.
