Defective Products Litigation
Ball Janik represented the designer and manufacturer of rugged industrial computer systems for use in harsh environments, who was sued by one of its customers for breach of contract and breach of warranty resulting from the supply of touch screen monitors to be used in industrial vehicles. The buyer claimed that the monitors failed in the field and that it suffered approximately $650,000 in damages as a result of the alleged failures. The manufacturer denied these claims and asserted that the problems with the monitors were the result of the buyer's failure to properly address needs within the environment that the monitors would be used. The manufacturer asserted counterclaims against the buyer as well.
After litigating various elements of the parties competing claims, the parties settled the lawsuit for $25,000, which was a fraction of the buyer’s demand.
