Dan Webert's practice focuses on residential and commercial construction litigation and the representation of community associations. He is an integral member of the firm's regional and growing national practice emphasizing design, construction, and product liability claims. As a litigator, Mr. Webert has participated as primary counsel in numerous multi-million dollar construction defect cases, including residential, multifamily and commercial buildings. His cases have included virtually all types of construction and have related to defects in building components ranging from siding and windows to plumbing and mechanical systems. He has litigated on behalf of thousands of owners and has participated in the recovery of tens-of-millions of dollars on their behalf. 

Mr. Webert's practice also emphasizes the representation of community associations as their general counsel. His experience and services include the interpretation of governing documents, compliance review, amendments, risk management and insurance, operating budgets and reserves, contract review, dispute resolution, collections and other general advice. He has lectured and presented at seminars on a variety of matters affecting homeowners, homeowners’ associations and community managers.

Mr. Webert started his career as a bankruptcy and construction litigator. In 2005, he joined a boutique firm specializing in the representation of community associations with construction defect claims. Mr. Webert joined Ball Janik LLP in 2008 to continue his focus on construction litigation and the representation of community associations.   

In 2009, Mr. Webert participated in the recovery of approximately $14 million for construction defects existing in a Multnomah County, Oregon shopping center and office park.

In 2010, he co-chaired, with Jim Prichard, a three-week, multi-party construction defect trial in Clark County, Washington. Mr. Webert and Mr. Prichard obtained a $3.3 million jury verdict on behalf of their condominium association client. They ultimately recovered over $5 million for the association.

In 2012, Mr. Webert helped recover in excess of $23 million for a large condominium in central Florida.

In addition to his construction defect experience, Mr. Webert has litigated construction lien, product liability, design professional and insurance recovery claims. He also has experience in a variety of commercial and real estate disputes. His early experience as a bankruptcy litigator provides valuable insight in claims brought against defunct developers, contractors and other businesses. 

Mr. Webert's professional affiliations reflect his interest in all types of commercial and construction litigation and the representation of community associations. He is a member of the Litigation and Tort and Insurance Sections of the American Bar Association, and the Construction Law Sections of the Oregon and Washington State Bars. He is active in the Oregon and Washington chapters of Community Association Institute (CAI) and Oregon Washington Community Association Managers (OWCAM).  Mr. Webert was recognized by his peers in Oregon Super Lawyers as a "Rising Star" in Construction Litigation in 2011.

Born and raised in Oregon, Mr. Webert attended Central Catholic High School. Following his undergraduate education at Oregon State University's Honors College, he obtained a prestigious doctoral fellowship to pursue his interest in the justice system. 

While in law school, Mr. Webert was a Senior Writing Fellow, assisting other law students with their writing, and was Executive Editor of the Georgetown Journal of Legal Ethics. He wrote an article for the American Criminal Law Review, and co-wrote a note for the Georgetown Journal of Legal Ethics. He also participated in the Georgetown Criminal Justice Clinic where he represented criminal defendants in the District of Columbia Superior Court.
